Terms and Conditions
The Energy Assessor reserves the right to withdraw from the inspection at any stage prior to completion. This cannot be construed as a Breach of Contract when assumptions that are made on the basis of information received at the initial enquiry stage are found to be false or misleading. These assumptions include:
- The property is in a safe condition and poses no threat to health and safety.
- There will at all times be an adult present at the property if the property contains any minors (children under the age of 18 years) or animals.
- Access will be made available for the Energy Assessors visual inspection of all parts of the property. If access is found to be restricted a ‘Not Inspected’ rating will be entered for that part affected, which will affect the completeness and/or accuracy of the Energy Performance Certificate.
- No part of the property or the premises to be visited is a building site.
- The property comes within the scope of the Domestic Energy Assessment Regulations and none of the exclusions apply.
- If the Domestic Energy Assessor identifies any potential or actual conflicts of interest they can immediately withdraw from the commission.
A statement of commission can be provided once the HIP has been commissioned and payment is received. (This document will provide evidence of the Home Information Pack purchase and allow the immediate marketing of the property).
The EPC will be made available within 24 hours after the Assessment date and the Home Information Pack will be completed within 7 to 10 working days of instruction.
If written notice of cancellation of the Energy Assessment by the client is not received within two working days of the Assessment Date, a cancellation fee of £30.00 will be required for time and expenses incurred up to receipt of the cancellation notice.
In accordance with the Data Protection Act the Domestic Energy Assessor will record only the personal data that is required to conduct their professional duty and specific to the commission.
The Domestic Energy Assessor will, at their request, inform a seller of their personal data held.
Please note: It is not the responsibility of the Domestic Energy Assessor to ensure the security of the property or any valuables contained within.
Exclusions of liability
Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Poolehips.com or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Law, jurisdiction and language
Any services offered by Poolehips.com are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
These terms and conditions do not affect your legal rights.
